General Terms and Conditions of Sale
Terms used herein with capital letters, unless previously defined, have the following meanings:
“Client” means a natural person, of legal age, acting for personal needs and with full legal capacity to commit under these terms.
“Reserved Rate Sales Conditions” means the specific conditions for each reservation made by the Client.
“Reservation Confirmation” means the document summarising the Client's reservation details, sent by the website or Residence.
“Reservation Request” means any request by the Client to book a Residence room.
“Residence” means Résidence LE TELEMAQUE, operated by SAS RESIDENCE LE TELEMAQUE, share capital €153,200.00 – VAT No: FR13379066947 – 20135 CONCA.
“Partners” means all service providers with a contract or partnership agreement with the Residence.
“Service” means any Residence room reservation service booked by the Client on the Residence website.
“Residence Website” means the website dedicated to the Residence at https://www.letelemaque.corsica .
Article 1 – Scope
These General Terms and Conditions of Sale apply without restriction or reserve to all purchases of Residence room reservation services and ancillary services (“Services”) offered by the Residence (“Provider” or “Residence”) to consumers and non-professional clients (“Clients”) on the Residence website. Service details are shown on the website. The Client must review them before booking. Service choice and purchase are the Client's sole responsibility.
The Client declares:
Having full legal capacity under these General Terms and Conditions of Sale.
Booking for personal needs.
Being able to save and print these terms.

These terms supersede others, especially for other sales channels. The Residence partners with third-party travel providers. Bookings via partners require Client acceptance of their specific terms, reserved rate conditions, and these general terms. The Client confirms obtaining all necessary information from the website. These terms are always accessible on the website and prevail over contradictory versions. Recorded data proves transactions. Bank details entry and acceptance equal handwritten signature. Registers are secure proof. Contracts are kept up to 5 years. IP is recorded at booking. Per Data Protection Act 1978, Client rights apply; contact SAS RESIDENCE LE TELEMAQUE – 20135 CONCA. These terms include the Personal Data Charter. Client acceptance occurs by checkbox before online booking and website terms. Reservation validation accepts these terms fully. Client confirms capacity. Applicable version is current at booking. Terms apply during online services; site may close.
Article 2 – Reservations
Client selects services as follows:
1.Choose room type and stay dates on Residence website.

3.Validate dates and add ancillaries.
4.Check details, total, rate conditions.
5.Enter details.
6.Provide card for guarantee/prepayment.
7.Accept terms and rate before validation.
8.Confirm booking.
Client acknowledges service nature and obtains info. Client responsible for choice. Info must be accurate. French contract info confirmed at validation. Online booking records on acceptance; Client can correct (Civil Code art. 1127-2). Validation proves contract. Verify and report errors. Sale final after email confirmation and payment. Distance contract forms. Residence may cancel for prior disputes. Reservations non-transferable. Flexible Rate Cancellation: After acceptance, <24h before stay: 1st night charged. Non-Cancellable/Non-Refundable: 100% prepaid retained for cancellation/modification/no-show.
Article 3 – Prices
Services are provided at rates in force on the Residence Website at recording. Prices are in Euros, net and gross. Rates include any reductions specified on the Website. They are firm and non-revisable during validity as indicated by the booking provider; outside, Provider may change prices. Rates shown before/during Client reservation, per room, persons, dates. Confirmed to Client gross (excl. tourist tax) in Residence currency, including VAT at reservation date rate; changes reflected automatically. Same for new taxes. Rates exclude tourist tax payable on-site: €0.55/person/day (under 10s exempt). Client pays without dispute. Reservation payment is 30% deposit (except Booking.com clients). Unless stated, extras (breakfast etc.) excluded. Foreign currency conversion indicative only. For on-site payment, if currencies differ, debited amount may vary due to exchange rates. Invoice provided upon Service delivery.
Article 4 – Payment Methods
Prepaid (Non-Cancellable/Non-Refundable): Full payment on confirmation via secure: Visa, MasterCard, Amex, other blue cards. Provide name, number, expiry (valid to stay end), CVV. SSL encrypted. Present card and ID on arrival (fraud prevention). No Services without full prior payment. Final on receipt. Pay on Arrival (Flexible): Full on delivery per invoice, secure cards as above. Balance due 15 days before stay. Cancellation refund only if ≥30 days notice. ID may be requested. No Services without payment. Final on receipt.
Article 5 – Service Delivery
Services provided per Terms and accepted Rate Conditions. On arrival, show ID for police form. No-smoking Residence; smoking damages charged fully (cleaning/restoration). Pets on leash/cage in common areas accepted per policy (+€3/day); not in dining. Linen not included; rental on request (ask rates). Personal items left (outside safe/public areas) Client's responsibility; Residence not liable for loss/theft/damage. Client uses room as good family head; immoral/public order breach leads to eviction without refund/compensation. Pay consumed nights if unpaid. Client liable for all damages caused; indemnify Residence fully (+costs). Leave apartment clean (self-clean or €100 fee). WiFi per policy; no illegal use (copyright infringement risks fines/jail per IP Code L.335-3). Comply with security policy. Check-in 2pm, check-out 12pm; late = extra night. Early departure: 1 night fee unless 24h notice. Provider best efforts (means obligation). Complaints within 8 days post-departure in writing with proof; else deemed accepted. Eviction: Force majeure etc., equivalent hotel if Client agrees.
Article 6 – Right of Withdrawal
Per Consumer Code L.221-28, no withdrawal right (L.221-18) due to Service nature. Contract final on reservation.
Article 7 – Provider Liability – Warranty
Provider warrants against non-conformity/hidden defects per law, no extra cost. Services comply with French regs; Client verifies foreign laws.
Article 8 – IT and Freedoms
Per 1978 Act, personal data necessary for booking/invoicing. Processed for Residence/partners (execution/payment). Newsletters/offers/surveys possible. Declared to CNIL. Access/rectify/oppose per regs on Website or site. See Personal Data Charter.
Article 9 – Intellectual Property
Website content property of Seller/Partners, protected by law. No reproduction; counterfeiting offence.
Article 10 – Unforeseeability
Terms exclude Civil Code art.1195; parties assume obligations despite imbalance.
Article 11 – Force Majeure
No liability if non-execution/delay from force majeure (Civil Code 1218).
Article 12 – Miscellaneous
These Terms, Data Charter, Rate Conditions, Request/Confirmation form full agreement, superseding priors. No waiver limits enforcement. Invalid clause doesn't affect rest.
Article 13 – Applicable Law – Language
French law governs. French version prevails if translated.
Article 14 – Disputes
Disputes (validity etc.) to French courts post-amicable fail. Mediation possible (Consumer Mediation Commission etc.).
Article 15 – Pre-Contractual Info – Client Acceptance
Client acknowledges clear prior communication of these terms and L221-5 Consumer Code info: essentials, price/fees, delivery date, Provider details, warranties, digital interoperability, mediation, key conditions, payments. Booking implies full acceptance/payment obligation; Client waives contradictory documents.
